Terms of Use

1. Acceptance of Terms

By accessing or using the Habit Capsules application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please discontinue use of the App immediately.

2. Beta Status

The App is currently in a beta testing phase and is provided free of charge during this period. A paid tier will be introduced at a future date. We do not guarantee uninterrupted availability, error-free performance, or the preservation of data during the beta phase. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

3. User Accounts and Identity

You are not required to use your legal name to create an account. You may register using a username, alias, or any online identity of your choosing. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of applicable laws
• Attempt to gain unauthorised access to any part of the App or its systems
• Upload or transmit harmful, offensive, or malicious content
• Reverse engineer, copy, or reproduce any part of the App without prior written consent

5. Intellectual Property

All content, features, frameworks, and methodology within the App — including but not limited to the Habit Capsules framework, Resilience Score, Habit Wealth concept, and PICR model — are the intellectual property of the App owner and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without explicit written permission.

6. Use of Artificial Intelligence

The App may incorporate AI-powered features to enhance your experience. Your data used in connection with these features will be anonymised. We do not use personally identifiable information in AI systems without your explicit consent.

The methodologies, frameworks, and concepts underlying the App — including but not limited to the Habit Capsules framework, the Resilience Score, Habit Wealth, and the PICR model — are original intellectual works conceived, developed, and authored by a human creator. These frameworks were not generated by artificial intelligence. AI tools may be used in the development and improvement of App features, but the core intellectual property represents the original creative contribution of its human author and is protected accordingly under applicable copyright and intellectual property law.

7. Anonymised Data and Marketing

We may use anonymised, aggregated data — including aggregated statistics and unattributed screenshots — for marketing, research, and product improvement purposes. Such materials will not be linked to any individual user.

Any use of personally identifiable information — including your name, attributed quotes, or identifiable images — for marketing purposes requires your prior explicit written consent, which you may withdraw at any time by contacting us.

8. Limitation of Liability

To the fullest extent permitted by law, Habit Capsules and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App, including loss of data during the beta phase.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms. You may close your account at any time by contacting us.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App owner is based, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App following notification of changes constitutes your acceptance of the revised Terms.
